Antitrust Suit Against Swisher Tossed Over Venue

Law360, New York (September 29, 2009, 4:31 PM EDT) -- A federal judge has dismissed an antitrust suit alleging cigar maker Swisher International Inc. committed price discrimination, saying the dispute should be settled in another venue under the terms of a credit agreement with plaintiff ISA Chicago Wholesale Inc.

Judge Joan Humphrey Lefkow of the U.S. District Court for the Northern District of Illinois said Friday that the lawsuit over Swisher's refusal to offer the Illinois distributor certain discounts should have been filed in Florida.
