City Denied Reconsideration In Sick Leave Case

Law360, New York (September 29, 2009, 1:14 PM EDT) -- Denying a motion for reconsideration from the city of Columbus, Ohio, a federal court has affirmed that a class of police officers claiming violations of privacy under the federal Rehabilitation Act will have its damages determined in the aggregate.

In an opinion issued Sept. 25 U.S. District Judge Gregory Frost of the Southern District of Ohio tore apart the city's motion for reconsideration, saying it misunderstood the plaintiffs' reasoning for seeking aggregate damages and failed to offer a fresh argument in opposition.
