Judge Warns Cuomo Over Atty. Fees In Investor Suit

Law360, New York (September 29, 2009, 5:55 PM EDT) -- A New York state court judge on Tuesday issued a stern warning to the office of state Attorney General Andrew Cuomo not to allow attorneys' fees to be paid out of a fund whose manager is accused of using the fund as a feeder for Bernard Madoff's massive ponzi scheme.

Cuomo's office sued investment manager Ezra Merkin in April on behalf of investors of several of Merkin's funds, including his Ariel Fund Ltd., a $1.3 billion dollar fund for foreign investors and nonprofit organizations, according to...
