Whirlpool Loses Bid To Nix Evidence In LG Dryer Suit

Law360, New York (September 30, 2009, 2:59 PM EDT) -- A federal judge has denied a bid by Whirlpool Corp. for summary judgment in LG Electronics USA Inc.'s suit alleging false advertising and Lanham Act violations in relation to steam dryers, rejecting Whirlpool's argument that the claims rely on inadmissible evidence.

Judge Amy St. Eve of the U.S. District Court for the Northern District of Illinois on Monday ruled that a customer survey used by LG to prove consumer confusion stemming from Whirlpool's advertisements for the dryers did not use inherently leading questions.
