Appeals Court Affirms ERISA Decision Over Severances

Law360 (October 26, 2006, 12:00 AM EDT) -- A federal appeals court affirmed a lower court decision Tuesday that 38 former and current employees were not entitled to the severance benefits they anticipated because of the plans’ wording and a series of sales involving their employer.

The U.S. Court of Appeals for the Third Circuit affirmed the ruling with little comment, simply saying Judge Yvette Kane for the U. S. District Court for the Middle District of Pennsylvania was right the first time.
