JFTC Orders Qualcomm To Drop Licensing Provisions

Law360, New York (September 30, 2009, 5:35 PM EDT) -- Japan's Fair Trade Commission has ordered wireless chipset manufacturer Qualcomm Inc. to eliminate cross-licensing and nonassert provisions in its patent-licensing agreements with Japanese companies that impede fair business practices.

The cease-and-desist order issued by Japan's regulatory agency Sept. 28 accuses Qualcomm of violating the country's Antimonopoly Act by preventing Japanese handset manufacturers from asserting their rights in their own intellectual property related to wireless communications technology that they are forced to license to Qualcomm on a royalty-free basis.
