Judge Chastises SPH For Foley Trade Secrets Suit

Law360, New York (October 1, 2009, 1:20 PM EDT) -- SPH America LLC has received a stinging rebuke from a federal judge for its “vexatious” legal battle accusing Foley & Lardner LLP of misappropriating trade secrets obtained in the firm’s representation of Kyocera Corp. against the patent-holding company in separate infringement litigation.

Judge Leonie Brinkema of the U.S. District Court for the Eastern District of Virginia issued the directive Tuesday, saying SPH must show cause as to why its complaint should not be dismissed with prejudice and Foley awarded costs as a prevailing party.
