Fed. Circ. Nixes Stanford U's Roche HIV Patent Suit

Law360, New York (October 1, 2009, 5:37 PM EDT) -- A federal appeals court has held that Stanford University lacked standing to bring an infringement suit against Roche Molecular Systems Inc. over patents covering HIV test kits, finding that Stanford did not own the patents outright.

The U.S. Court of Appeals for the Federal Circuit on Wednesday ruled against Stanford as the lower court had done, but on different grounds.
