Learjet Suit Remanded After Failed Class Bid

Law360, New York (October 1, 2009, 3:28 PM EDT) -- A federal judge has agreed to return a product liability suit against Learjet Inc. to state court after rejecting a bid for class status by charter plane company Cunningham Charter Corp.

Agreeing that the denial of class certification stripped his court of subject matter jurisdiction, Judge David Herndon of the U.S. District Court for the Southern District of Illinois on Wednesday granted Cunningham's motion to have the action remanded to the First Judicial Circuit, Union County, Ill.
