Hospital To Appeal In CR Bard Catheter Antitrust Suit

Law360, New York (October 1, 2009, 12:10 PM EDT) -- A hospital whose antitrust class action against medical technology manufacturer C.R. Bard Inc. was dismissed has said it will appeal because the magistrate judge erred in tossing claims that the company schemed to drive up the prices of urological catheters.

St. Francis Medical Center filed a notice of appeal on Wednesday in the U.S. District Court for the Eastern District of Missouri, challenging Judge Thomas C. Mummert III's decision on Monday to grant Bard's motion for summary judgment.
