Texas AG Appeals Same-Sex Divorce Order

Law360, New York (October 2, 2009, 6:20 PM EDT) -- The Texas attorney general's office has appealed a state court judge's order allowing two men married in Massachusetts to divorce in Texas.

The notice of appeal was filed Friday, one day after Judge Tena Callahan of the Dallas County District Court ruled that the Texas Constitution and the Texas Family Code, which ban same-sex marriage, violated the right to equal protection and therefore violated the 14th amendment to the U.S. Constitution.
