Citgo Loses Bid To Toss Price-Fixing Action

Law360, New York (October 5, 2009, 3:57 PM EDT) -- A federal judge has rejected a request by Citgo Petroleum Corp. to dismiss a putative antitrust class action, including breach of contract claims, brought by gasoline distributors alleging that the oil giant offered secret discounted rates to certain distributors.

Judge Terence Kern of the U.S. District Court for the Northern District of Oklahoma on Friday denied Citgo's contention that the plaintiffs had failed to demonstrate they were similarly situated to the distributors that purportedly received special treatment.
