Full Fed. Circ. Urged To Eye Alice Win For Tech Titans

Law360 (April 16, 2020, 5:33 PM EDT) -- A company whose patents asserted against Apple, Twitter and others were invalidated as abstract asked the full Federal Circuit Wednesday to review that decision, saying it endorsed the "outdated and erroneous practice" of district judges making Alice rulings before claim construction.

Voip-Pal.com Inc. filed a petition seeking en banc review of the one-line Federal Circuit order from March. The court upheld a decision by Judge Lucy Koh of the Northern District of California that the company's call-routing patents cover a patent-ineligible abstract idea under the U.S. Supreme Court's Alice holding.
