Suit Seeks to Force Texas Agency To Regulate GHG

Law360, New York (October 6, 2009, 6:35 PM EDT) -- Consumer interest group Public Citizen on Tuesday slapped Texas' environmental agency with a lawsuit seeking to force the regulation of greenhouse gases and asking the court to declare that power plants cannot be issued construction permits without an examination of carbon dioxide emissions.

The case filed in the Travis County District Court claims that under the Texas Clean Air Act, carbon dioxide is an air pollutant, and argues that, as such, the Texas Commission on Environmental Quality is required to regulate it.
