CIT Tosses Plastic Bag Anti-Dumping Duty Dispute

Law360, New York (October 9, 2009, 3:34 PM EDT) -- The U.S. Court of International Trade has dismissed a Puerto Rican customs broker's suit over anti-dumping duties imposed on plastic shopping bags imported from Thailand, ruling that the company had failed to state a claim on which relief could be granted.

Judge Gregory W. Carman of the CIT ruled Thursday that San Juan-based G. Padilla & Co.'s suit protesting the $92,000 in dumping duties did not state a claim that the court has subject matter jurisdiction over it under Section 1581(i).
