Apotex Appeals Abbott Depakote Ruling

Law360, New York (April 14, 2004, 12:00 AM EDT) -- Canadian drug maker Apotex has filed an appeal to the U.S. Court of Appeals for the Federal Circuit of a U.S. District Court ruling that found its generic divalproex sodium had infringed Abbott Laboratories' intellectual property covering epilepsy drug Depakote.

Apotex's appeal is based on the claim that the district court judge “unduly restricted the scope of the trial and Apotex's evidence,” the company said.
