11th Circ. Revives Ford Class Action

Law360, New York (October 19, 2009, 1:51 PM EDT) -- A federal appeals court has brought back to life a class action alleging “extreme” oscillation in some Ford Motor Co. trucks, saying the district court that dismissed the case should have granted the class leave to amend its complaint.

In an opinion issued Friday, a three-judge panel on the U.S. Court of Appeals for the Eleventh Circuit said the lower court was right to grant Ford's motion to dismiss, but wrong to preemptively rule that granting leave to amend "would be an exercise in futility."...
