Texas Panel Gives Electricity Co. Another Go At Tower Owner

Law360 (July 14, 2020, 10:23 PM EDT) -- A Houston retail electricity provider will get another chance to hold a former customer accountable for unpaid bills and breach of contract after a Texas appeals panel ruled the trial court erred in dismissing the case.

Reviving a decade-old dispute, a three-judge First Court of Appeals panel said on Tuesday that the trial court had improperly dismissed the case after Startex Power, formerly known as Star Electricity Inc., was unable to produce its key witness for a deposition in 2016.
