Continental Seeks Commerce Docs In D&O Spat

Law360, New York (October 20, 2009, 5:18 PM EDT) -- Continental Casualty Co. has asked a court to order Commerce Bancorp LLC to produce documents related to $12 million in legal fees the bank incurred defending government investigations and shareholder suits over the conduct and departure of former CEO Vernon W. Hill, which Commerce wants the insurer to pay.

In motions filed Monday in the U.S. District Court for the District of New Jersey, Continental said that Commerce can't ask Continental to indemnify it for legal defense costs while hiding the exact nature of those costs...
