DC Circ. Upholds FERC Order To Redo Pipeline Rates

Law360 (July 24, 2020, 5:33 PM EDT) -- The D.C. Circuit on Friday backed the Federal Energy Regulatory Commission in a long-running fight with a Kinder Morgan unit over the agency's order that the company redo its math on gas pipeline rates.

An appeals court panel said FERC had enough reason and evidence in 2012 to order El Paso Natural Gas Co. LLC to remove more than $700 million from the calculation of the pipeline's rates, which ultimately reduced the rates the company was able to set for its customers. The panel rejected El Paso's contention that FERC ignored its own precedent in doing so.
