2nd Circ. Revives Exxon Gas Station Pollution Suit

Law360, New York (October 21, 2009, 2:28 PM EDT) -- A federal appeals court has resurrected a legal tangle involving Exxon Mobil Corp., a restaurant operator and a gas station owner over alleged contamination from leaking underground petroleum storage tanks in Plattsburgh, N.Y.

The U.S. Court of Appeals for the Second Circuit on Tuesday vacated part of a lower court's ruling, which had dismissed a suit John Lambrinos, the owner of Gus' Red Hots Restaurant, filed against ExxonMobil and Donald Gagnier, the operator of one of the oil company's gas stations who later became the owner....
