Donning, Doffing Suit Against Koch Foods Decertified

Law360, New York (October 21, 2009, 7:04 PM EDT) -- A federal judge has decertified a class of more than 1,300 employees of Koch Foods Inc. in Mississippi who accused the chicken processor of failing to pay them for the time spent donning and doffing their work clothes.

Judge Keith Starrett of the U.S. District Court for the Southern District of Mississippi on Tuesday granted Koch's motion to decertify after finding that the situations of the various opt-in plaintiffs were too different to merit a collective action.
