Illinois Central Let Off Hook In Miss. Pollution Suit

Law360, New York (October 22, 2009, 3:28 PM EDT) -- A federal judge has ruled that Illinois Central Railroad Co. is not responsible for pollution stemming from a wood-treatment plant in Mississippi for which the railroad operator was the biggest customer.

Judge W. Allen Pepper Jr. of the U.S. District Court for the Northern District of Mississippi found Tuesday that Illinois Central did not have enough control over Koppers Industries Inc., which ran the plant, for the railroad company to be liable for Koppers' alleged actions.
