Decertification Stands In Canada Vioxx Suit

Law360, New York (October 22, 2009, 4:43 PM EDT) -- Canada's Supreme Court has declined to review an order by a court in Saskatchewan that decertified a class action over Merck & Co. Inc.'s withdrawn painkiller Vioxx.

Merck said in a statement that the court's decision not to review the March ruling by the Court of Appeal for Saskatchewan means it will remain in effect.

A lower court in the province in 2008 certified a class of Canadian residents in all provinces except Quebec who purchased or ingested Vioxx. The province appeals court overturned that ruling...
