1st Circ. Vacates Remand Of Dentist Case V. Insurers

Law360, New York (October 22, 2009, 7:23 PM EDT) -- A federal appeals court has held that a case brought by a Puerto Rican dentist group against Connecticut General Life Insurance Co., Metropolitan Life Insurance Co. and others was a proposed class action even though the plaintiff class was not specifically defined and that a lower court acted prematurely by remanding it.

Siding with the insurers' arguments, the U.S. Court of Appeals for the First Circuit on Thursday vacated the remand order and remitted the case for further proceedings in the district court.
