Law360, New York (October 28, 2009, 6:09 PM EDT) -- In a legal malpractice suit arising from an allegedly botched patent litigation defense, Livingston & Mattesich Law Corp. and former client Gale Corp. are waiting for a federal judge to rule on the extent of expert testimony allowed in their battle over attorneys' fees.

Both parties submitted supplemental briefs in the U.S. District Court for the Eastern District of California on Tuesday, with Gale insisting that the case should be governed by the Federal Rules of Civil Procedure, which have more flexible allowances for expert testimony,...
