1st Circ. Rejects Challenge Of LNG Lease Approval

Law360, New York (October 29, 2009, 2:00 PM EDT) -- Members of the Passamaquoddy Tribe have again been shot down in their attempt to challenge a Bureau of Indian Affairs decision to approve a lease of a plot of the tribe's land for the construction and operation of a liquefied natural gas facility, contingent on Federal Energy Regulatory Commission approval.

The U.S. Court of Appeals for the First Circuit on Wednesday affirmed a district court's judgment that the members had not exhausted internal remedies and had not won an exception to that requirement.
