7th Circ. Lets Insurer Off Hook For Atty Malpractice Suit

Law360, New York (October 28, 2009, 8:16 PM EDT) -- A federal appeals court on Wednesday reversed a lower court decision in favor of Kemper Casualty Insurance Co. finding James River Insurance Co. liable to indemnify two attorneys in an underlying malpractice suit, saying the claims in question relate to incidents that took place before the James River policy began.

The U.S. Court of Appeals for the Seventh Circuit overturned a September 2008 ruling by the U.S. District Court for the Northern District of Illinois holding that James River had a duty to indemnify.
