Waitresses Sue Hooters Over Tips In FLSA Dispute

Law360, New York (November 2, 2009, 1:09 PM EST) -- Two Hooters of America Inc. waitresses have slapped several Long Island branches of the restaurant with a putative class action alleging the management misappropriated their tips and failed to reimburse them for their uniforms, in violation of the Fair Labor Standards Act and New York labor laws.

The suit, filed Thursday in the U.S. District Court for the Eastern District of New York, says that the Hooters managers were effectively paying part of the wages of the restaurants' kitchen staff with 2 percent of the waitresses'...
