Metaldyne Creditors Want Sale Appeal Tossed

Law360, New York (November 2, 2009, 6:41 PM EST) -- The official committee of unsecured creditors in the Metaldyne Corp. bankruptcy has asked the court to toss an appeal from BDC Finance LLC, which claims the auction was really a gussied-up private mergers and acquisitions negotiation.

The unsecured creditors filed a motion to dismiss BDC's appeal on Friday in the U.S. District Court for the Southern District of New York, joining buyer MD Investors Corp., which also has voiced opposition to BDC's appeal.
