Advocates Can Subpoena White House In Plan B Suit

Law360, New York (November 9, 2006, 12:00 AM EST) -- A federal magistrate judge has ruled that reproductive rights advocates can have access to White House documents in a lawsuit over the U.S. Food and Drug Administration's handling of the morning-after pill.

Magistrate Judge Viktor Pohorelsky of the U.S. District Court for the Eastern District of New York said in a Monday ruling that advocates including the Center for Reproductive Rights had demonstrated the FDA exhibited "strong showing of bad faith" in its decision-making concerning Plan B.
