Dell Laptop Battery Complaint Fails Under CAFA: Judge

Law360, New York (November 4, 2009, 1:04 PM EST) -- After reviewing a putative class action accusing computer makers including Dell Inc. and Gateway Inc. of exaggerating the battery life of laptops, a federal judge on Wednesday told the plaintiffs to file a new version of their complaint properly establishing the court's jurisdiction under the Class Action Fairness Act or face dismissal.

Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois entered the order following his sua sponte review of the complaint, filed Oct. 20 by named plaintiffs Mike's Inc....
