Contract Suit Against Conoco Time-Barred: 10th Circ.

Law360, New York (November 5, 2009, 5:44 PM EST) -- A federal appeals court has upheld a decision that Badwey Oil Inc. waited too long to file suit against ConocoPhillips Petroleum Co. for allegedly breaching a contract related to marketing gasoline products.

Forgoing oral arguments on the matter after reviewing the briefs, the U.S. Court of Appeals for the Tenth Circuit on Wednesday affirmed a grant of summary judgment to Conoco on the ground that Badwey’s claims were barred by a four-year statute of limitations for sales contracts.
