2nd Circ. OKs Agway Post-Ch. 11 Attorneys' Fee

Law360, New York (November 5, 2009, 7:40 PM EST) -- A federal appeals court has determined that the liquidating trust for the now-defunct Agway Inc. must pay nearly $885,000 in post-bankruptcy attorneys' fees on a claim stemming from a prepetition indemnity agreement.

In an opinion issued on Thursday by the U.S. Court of Appeals for the Second Circuit, the three-judge panel affirmed a decision from the U.S. District Court for the Northern District of New York that said a bankruptcy judge was correct in granting the attorneys' fees.
