High Court Declines To Hear Every Penny Counts Suit

Law360, New York (November 9, 2009, 2:42 PM EST) -- The U.S. Supreme Court has declined to take on Every Penny Counts Inc.'s appeal of a claims construction ruling that the company claimed misapplied the high court's 1996 ruling in Markman v. Westview Instruments.

The high court on Monday denied EPC's petition for writ of certiorari in a patent infringement case against a group of credit card and gift card companies, including American Express Co., MasterCard International Inc. and Visa USA Inc.
