FEMA Trailer Supplier Fights Express Warranty Claim

Law360, New York (November 9, 2009, 5:18 PM EST) -- Fleetwood Enterprises Inc. is challenging an express warranty claim under Louisiana products liability law in a bellwether case over formaldehyde levels in emergency housing provided to hurricane victims.

The company argued in a filing Monday in the U.S. District Court for the Eastern District of Louisiana for partial summary judgment on plaintiff Timia Dubuclet's allegations for breach of express warranty, saying she can't show that she relied on any such warranty from Fleetwood, which is one of the manufacturers of the emergency housing units.
