Conceptus Fails To Block Rival Contraceptive System

Law360, New York (November 10, 2009, 2:21 PM EST) -- A federal judge has denied Conceptus Inc.'s motion for a preliminary injunction in its patent infringement suit against Hologic Inc., allowing the rival medical device maker to continue selling a permanent contraception system that does not involve incisions.

Judge William Alsup of the U.S. District Court for the Northern District of California ruled Friday that Conceptus had not met its burden on the likelihood of success, that it was in trouble on validity grounds and that there was no showing of irreparable harm.
