Judge Denies Motion To Halt TVA Ash Spill Cleanup

Law360, New York (November 11, 2009, 1:42 PM EST) -- A federal judge has denied an emergency injunction to a putative class of landowners neighboring the Tennessee Valley Authority coal plant at the center of last winter’s record ash sludge spill who had sought to block TVA from cleaning up the area until a detailed environmental impact analysis of the event could be recorded.

In the U.S. District Court for the Eastern District of Tennessee Monday, Judge Thomas Varlan sided with the coal plant, ruling that the facility’s designation as a Superfund site by the U.S....
