Insurer Says No Coverage For Leaks Damage Before Policy

Law360 (December 15, 2020, 10:18 AM EST) -- Middlesex Insurance sued a Mississippi construction company in federal court Monday alleging it doesn't owe coverage for an underlying lawsuit of at least $2 million from a school system over a leaky roof.

West Brothers Construction Inc. doesn't qualify for a defense in its lawsuit brought by the Lowndes County School District for its construction of the roof at a new high school as it was placed on notice of the claims as far back as 2017 and 2018, and Middlesex Insurance Co.'s policy only began in 2019, according to court documents.
