Frommer Bumped From Merck, ProThera Patent Suit

Law360, New York (November 13, 2009, 5:36 PM EST) -- A federal judge has upheld a magistrate judge's ruling disqualifying Frommer Lawrence & Haug LLP from representing ProThera Inc. in an intellectual property dispute with Merck Eprova AG.

Judge Richard M. Berman of the U.S. District Court for the Southern District of New York on Thursday affirmed Magistrate Judge James C. Francis IV's September order disqualifying the firm because it couldn't demonstrate that there was no “actual or apparent conflict in loyalties” or that the “vigor of its representation would not be diminished.”
