Horizon Sails Clear Of Investor Fraud Suit

Law360, New York (November 13, 2009, 6:27 PM EST) -- Deeming the plaintiffs' fraud allegations fatally general, a federal judge has jettisoned a putative class action accusing Horizon Lines Inc. and its senior officers of hiding from investors the fact that a price-fixing scheme propped up the shipping company's revenue gains.

On Friday Judge Harvey Bartle III of the U.S. District Court for the District of Delaware held that the plaintiffs — a collection of pension funds — failed to particularize the pleadings and tie the price-fixing conspiracy to the corporate officers signing Horizon’s regulatory filings....
