Koch, Workers To Enter Mediation Over FLSA Claims

Law360, New York (November 16, 2009, 4:21 PM EST) -- Koch Foods LLC will enter court-ordered mediation in an effort to settle a collective action brought by workers at chicken processing facilities in Morristown, Tenn., who argue they were not given bona fide meal breaks.

While granting the plaintiffs' request to order mediation, Judge Leon Jordan of the U.S. District Court for the Eastern District of Tennessee on Friday also awarded summary judgment to Koch on its defense that a donning and doffing claim was barred under a collective bargaining agreement.
