Court Remands Suit Over Disputed Reinsurance Policy

Law360, New York (November 19, 2009, 6:18 PM EST) -- A federal judge has remanded an insurance dispute between the liquidator of now-defunct Midland Insurance Co. and Serbia-based Dunav Re a.d.o. over around $3 million in disputed reinsurance coverage to state court.

Judge Denise Cote of the U.S. District Court for the Southern District of New York on Thursday sent the suit back to the New York Supreme Court, finding that the “service of suit” provision included in each of the reinsurance agreements between the parties required Dunav to submit to jurisdiction in any proper forum...
