Judge Dismisses MedImmune's Patent Suit Vs. Genentech
Law360 (April 24, 2004, 12:00 AM EDT) -- A U.S. District Court judge has dismissed MedImmune patent lawsuit against biotech company Genentech over technology to create drugs using antibody molecules.
U.S. District Judge Mariana Pfaelzer in the U.S. District Court for the Central District of California ruled the case cannot be considered because there is no “actual controversy” between Genentech and MedImmune.
“Because MedImmune is a licensee in good standing, and because the relief MedImmune seeks is declaratory judgment, this court has no choice but to dismiss this case for lack of subject matter jurisdiction,” Pfaelzer wrote in her 12-page opinion.
