5th Circ. Refuses To Rule On Unfinished Hail Damage Claim
Law360 (February 23, 2021, 6:16 PM EST) -- The Fifth Circuit refused to weigh in on a church's challenge to a lower court's ruling in favor of its insurer over hail damage, saying the court does not have the authority to decide on the case since the federal district court never resolved the policyholder's counterclaims against its carrier.
A three-judge panel said on Monday that the Fifth Circuit only rules on appeals from "final decisions of the district court," but the Texas federal court failed to address the First United Methodist Church's counterclaims against GuideOne Insurance Co. before entering a judgment.
