DC Circ. Says NC Can't Seek EPA Rule Review

Law360, New York (November 24, 2009, 5:55 PM EST) -- A federal appeals court has ruled that the state of North Carolina lacks standing to petition for review of a U.S. Environmental Protection Agency rule removing a region of Georgia from regulations under the national ambient air quality standard for ozone.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit said Tuesday that Georgia plans to use compliance supplement pool credits to cover its excess emissions, which resolves the question of redressability.
