GSK Prevails In Sales Rep Overtime Suit

Law360, New York (November 25, 2009, 2:06 PM EST) -- A federal judge has ruled that pharmaceutical sales representatives are exempt from overtime regulations because their work constitutes outside sales, handing a victory to GlaxoSmithKline PLC in a proposed Fair Labor Standards Act class action.

Judge Frederick J. Martone of the U.S. District Court for the District of Arizona on Friday granted GSK's motion for summary judgment and dismissed the suit filed in August 2008 by two of the company's sales representatives.
