California Company Sues Reed Smith Over Patent Filing

Law360, New York (April 28, 2004, 12:00 AM EDT) -- Deposition Sciences Inc. has sued Reed Smith over what the company claims is a botched patent filing.

According to the complaint, filed April 13 in San Francisco, lawyers at Crosby, Heafey, Roach & May, later acquired by Reed Smith, made a filing error that caused it to lose the rights to its patent in eight European countries.

The suit asserts that Crosby Heafey recorded that the patent's "maintenance file" had been transferred, indicating the firm was no longer responsible for it.
