Calif. Water Agency Challenges Federal Fish Plan

Law360, New York (December 2, 2009, 6:11 PM EST) -- The California Department of Water Resources is suing the U.S. government over its plan to alter water supply projects to protect the threatened delta smelt fish, saying the plan violates the Endangered Species Act and could hinder water delivery efforts.

The department filed its complaint Monday in the U.S. District Court for the Eastern District of California in a consolidated case that includes several citizen groups and water authorities that have also challenged the federal government's delta smelt plan.
