Pharmacies' Suit Over Pfizer-Wyeth Merger Dismissed

Law360, New York (December 4, 2009, 3:35 PM EST) -- A federal judge has tentatively tossed an antitrust suit over Pfizer's $68 billion buyout of rival Wyeth, but gave the group of California pharmacies opposed to the deal one more chance to make a case under the Clayton and Sherman Antitrust Acts.

After winning a dismissal of the initial complaint, Pfizer argued that the pharmacies' first amended complaint was, as Yogi Berra would put it, “deja vu all over again.”
